Divorce on Demand is deeply committed to your right to privacy and takes your privacy seriously. We have very strict privacy policies and we strive to keep your personal and financial information secure.
Divorce on Demand uses a number of internal and third-party methods to recognize visitor data like IP addresses and browser settings (collectively 'Visitor Data'). DIVORCE ON DEMAND'S internal servers and software automatically recognize Visitor Data. No Personally Identifiable Information (as defined below) is revealed in this process. The Site may also use Visitor Data to compile traffic data about the kind and types of visitors who use the Site at specific intervals (collectively 'Traffic Data').
We may use Traffic Data information to analyze our Site traffic, but such information is not examined for Personally Identifiable Information. We may also use Traffic Data to help diagnose problems with our server, to administer our Site, or to display content according to your preferences. Traffic and transaction information may also be shared with business partners, affiliates, and/or advertisers on an aggregated and anonymous basis.
Divorce on Demand requires each client to provide us with personal information (collectively 'Personally Identifiable Information') to access and use DIVORCE ON DEMAND'S products and services. Please be advised that certain personal information becomes public record when documents are filed with the federal government, the state, or a court.
Personally Identifiable Information includes, but is not limited to: (i) 'Contact Data' (such as your name, address, city, state, zip code, phone number, and email address); (ii) 'Financial Data' (such as your credit card number, expiration date, and verification code); (iii) 'Demographic Data' (such as your zip code and gender); and (iv) other 'Legal Data' (such as your social security number, mortgage information, automobile information, marital information, trade secrets, inventions, and/or idea submissions and other sensitive information necessary to generate proper legal documents). This Personally Identifiable Information is necessary to generate the products and services created by our Divorce on Demand web application.
Divorce on Demand, sometimes with third party assistance, may use your Personally Identifiable Information to verify your identity and initiate your case and payment through merchant account services, to generate the products and services you create with our Divorce on Demand web application, and to analyze our client demographics to better serve you. Your Contact Data may be used to follow up with you on transactions initiated on the Site, respond to inquiries made through the Site, inform you of changes to the Site, and send you additional information about Divorce on Demand and its products. Unless specifically authorized by you, we do not provide Personally Identifiable Information to third parties, except as necessary to provide you with services. We may be required to disclose information to third parties if we receive a subpoena or to otherwise comply with the law.
Please note that Contact Data and Traffic Data are used to gather general statistics about our clients and visitors, respectively, to enhance the consumer experience on the Site. We may also use Demographic Data in a way that does not identify you specifically or allow you to be contacted but that provides collective information about our users. For example, we may inform third parties about the number of registered users, number of unique visitors, and the pages most frequently browsed.
You may choose not to provide us with any Personally Identifiable Information or you may turn off cookies in your browser by changing its settings. If you make these decisions, Divorce on Demand cannot initiate cases without this information.
If you do not wish to receive information and/or promotional materials from Divorce on Demand or from our partners, you may choose to 'opt-out' when Divorce on Demand creates your account or may unsubscribe from our mailing list on any one of the promotions or other materials we send.
We may work with third-party service providers that we do not own or control. Unless specifically authorized by you, we do not provide your Personally Identifiable Information to any third-party service providers, except to fulfill your case.
We strive to make certain that our servers and connections incorporate the latest encryption and security devices. To prevent unauthorized access, we have implemented physical, electronic, and managerial procedures to safeguard and secure the information we collect. Credit card and personal information are transmitted by secure servers.
When the Services are accessed using a modern web browser Secure Socket Layer (.SSL.) technology protects Client Data using both server authentication and data encryption. These technologies help ensure that Client Data is safe, secure, and only available to the Client to whom the information belongs and those to whom the Client has granted access.
Clients are responsible for maintaining the security and confidentiality of their Divorce on Demand usernames and passwords.
Divorce on Demand has security measures in place to prevent the loss, misuse, destruction, and alteration of the information you provide us. We will have no liability to you or to any third party if any such loss, misuse, destruction, or alteration occurs.
Divorce on Demand reserves the right to change this Privacy Statement. Divorce on Demand will provide notification of the material changes to this Privacy Statement through the Company’s Web site.

DIVORCE ON DEMAND'S Services also include a review of your answers for completeness, spelling and grammar, and for internal consistency of names, addresses and the like. If you chose the petition, judgement or petition and judgement options, Divorce on Demand Services will not extend beyond that review and Divorce on Demand will not provide legal advice or apply the law to the fact of your particular situation as you have given them to Divorce on Demand. Divorce on Demand and its Services are not substitutes for the advice of an attorney. Divorce on Demand provides additional certified attorney support at an additional cost to you under the consultation option.

If the Divorce on Demand technical staff suspects a user name is being used by someone who is not authorized by the proper user, Divorce on Demand may temporarily disable that user's access in order to preserve system security. In all such cases, Divorce on Demand will contact the member as soon as feasible.
Divorce on Demand reserves the right to refuse service to anyone and to cancel user access at any time.
You are legally and ethically responsible for any User Content - writings, files, pictures or any other work - that you post or transmit using any Divorce on Demand service that allows interaction or dissemination of information. In posting User Content, you are responsible for honoring the rights of others, including intellectual-property rights (copyright, patent and trademark), the right to privacy and the right not to be libeled or slandered. These Terms of Service Represent a Contract
These Terms of Service are a contract between you and Stahancyk, Kent & Hook, a company with its principle place of business at 2400 SW 4th Avenue, Portland OR 97201 USA (“Stahancyk, Kent & Hook”). Stahancyk, Kent & Hook operates DivorceOnDemand.com (“Divorce on Demand Site”) and the form document generation, collection and storage services therein (collectively the “Service”). By using the Divorce on Demand Site and any services accessible from the Divorce on Demand Site, you are agreeing to be bound by the following terms and conditions (“Terms of Service”).
If you do not agree to these Terms of Service or any part thereof, your only remedy is to not use the Divorce on Demand Site or the Service. VIOLATION OF ANY OF THE TERMS BELOW WILL RESULT IN THE TERMINATION OF YOUR RIGHT TO USE THE Divorce on Demand SITE, AND ANY ACCOUNT THAT YOU MAY HAVE CREATED AS PART OF THE SERVICE. YOU AGREE TO USE THE Divorce on Demand SITE AT YOUR OWN RISK.
Stahancyk, Kent & Hook hereby grants you a non-exclusive, non-transferable, worldwide right to access and use the Divorce on Demand Site, solely with supported browsers through the Internet for your own purposes, subject to the Terms of Service. You may not permit the Divorce on Demand Site to be used by or for the benefit of unauthorized third parties. Nothing in the Terms of Service shall be construed to grant you any right to transfer or assign rights to access or use the Divorce on Demand Site. All rights not expressly granted to you are reserved by Stahancyk, Kent & Hook and its licensors. You shall not (i) modify or make derivative works based upon the Divorce on Demand Site; (ii) reverse engineer or access the Divorce on Demand Site in order to (a) build a competitive product or service, (b) build a product using similar features, functions or graphics of the Divorce on Demand Site, or (c) copy any features, functions or graphics of the Divorce on Demand Site. You further acknowledge and agree that, as between the parties, Stahancyk, Kent & Hook owns all right, title, and interest in and to the Divorce on Demand Site, including all intellectual property rights therein.
As a condition to your use of the Divorce on Demand Site, you agree:
You are responsible for all activity occurring under your account and are solely responsible for compliance with all applicable local, state, national and foreign laws, treaties and regulations relating to your use of the Divorce on Demand Site, including those related to the protection of intellectual property, data privacy, international communications and the transmission of technical or personal data.
You shall: (i) notify Divorce on Demand.com immediately of any unauthorized use of any password or account or any other known or suspected breach of security; and (ii) report to Divorce on Demand immediately and use reasonable efforts to stop immediately any copying or distribution of Content that is known or suspected by you. You can notify Divorce on Demand of any unauthorized use or suspected breach of security at firstname.lastname@example.org.
You are responsible for obtaining and maintaining any equipment and ancillary services needed to connect to, access or otherwise use the Divorce on Demand Site, including, without limitation, modems, hardware, server, software, Internet browsers operating system, networking, web servers, long distance and local telephone service, but excluding the Divorce on Demand Site itself (collectively, “Equipment”). You shall be responsible for ensuring that such Equipment is compatible with the Divorce on Demand Site. You shall also be responsible for the use, and maintaining the security, of the Equipment.
As a condition to your use of the Divorce on Demand Site, you agree not to:
Stahancyk, Kent & Hook will indemnify all paying accounts against and hold them harmless from: (a) any claim by a third party that any part of the Divorce on Demand Site or its use, manufacture, sale, distribution, or reproduction infringes or misappropriates any copyrights, trade secrets, patents or other intellectual property; (b) any claim by a third party that this Terms of Service is in conflict, violation or breach of or with any contract, assignment, license, sublicense, security interest, or other obligation to which Stahancyk, Kent & Hook is a party or has knowledge; (c) any claim relating to any past, present or future use, licensing, sub-licensing, distribution, marketing, disclosure or commercialization of any part of the Divorce on Demand Site by Stahancyk, Kent & Hook; and (d) any litigation, arbitration, judgments, awards, attorneys’ fees, liabilities, settlements, damages, losses and expenses relating to or arising from (a), (b) or (c) above.
In the course of using the Divorce on Demand Site, you may provide Stahancyk, Kent & Hook with feedback, including but not limited to suggestions, observations, errors, problems, and defects regarding the Divorce on Demand Site (collectively “Feedback”). You hereby grant Stahancyk, Kent & Hook a worldwide, irrevocable, perpetual, royalty-free, transferable and sub-licensable, non-exclusive right to use, copy, modify, distribute, display, perform, create derivative works from and otherwise exploit all such Feedback.
A valid credit card or, PayPal account is required for payment. Payment is only accepted through our online payment system. All payments are accepted in advance before the Divorce on Demand service can be accessed.
All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities, and you shall be responsible for payment of all such taxes, levies, or duties, excluding only United States (federal or state) taxes. You agree to pay for any such taxes that might be applicable to your use of the Service and payments made by you herein.
Divorce on Demand is a service available to Oregonians who need help with the paperwork for a simple divorce. Some divorces are more complicated, and should be handled with a traditional attorney-client relationship.
We have pre-screening protocols that the user completes before payment is requested, to ensure that Divorce on Demand is the right choice for the user. It is our hope that the pre-screening questions make refunds unlikely, once a user has elected to purchase the Divorce on Demand service, but we will provide refunds to users if they are not able to complete the online questionnaire because they do not meet the appropriate requirements.
Stahancyk, Kent & Hook reserves the right to investigate and prosecute violations of any of these Terms of Service to the fullest extent of the law. Stahancyk, Kent & Hook may involve and cooperate with law enforcement authorities in prosecuting users who violate the Terms of Service. You acknowledge that Stahancyk, Kent & Hook has no obligation to pre-screen or monitor your access to or use of the Divorce on Demand Site or any information, materials or other content provided or made available through the Divorce on Demand Site, but has the right to do so. You hereby agree that Stahancyk, Kent & Hook may, in the exercise of Stahancyk, Kent & Hook’s sole discretion, remove or delete any entries, information, materials or other content that violates these Terms of Service or that is otherwise objectionable.
You are solely responsible for properly canceling your account. You can cancel your account at any time by writing Stahancyk, Kent & Hook a letter to the following address:

You must provide your Account information in the letter or your cancellation request cannot be granted. Any cancellation of your Account will result in the deactivation and deletion of your Account, and the forfeiture and relinquishment of all Content in your Account. This information cannot be recovered from Stahancyk, Kent & Hook once your account is cancelled. Please be aware that Stahancyk, Kent & Hook may for a time retain residual information in our backup and/or archival copies of our database. We will make reasonable commercial efforts to delete your information as soon as possible.
Stahancyk, Kent & Hook reserves the right to refuse service to anyone for any reason at any time.
Stahancyk, Kent & Hook reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Divorce on Demand Site and Service (or any part thereof) with or without notice. Stahancyk, Kent & Hook reserves the right to update and change the Terms of Service from time to time without notice. Any new features that augment or enhance the current Divorce on Demand Site, including the release of new tools and resources, shall be subject to the Terms of Service. Continued use of the Divorce on Demand Site after any such changes shall constitute your consent to such changes.
We claim no intellectual property rights over the material you provide to the Divorce on Demand Site. Your profile and materials uploaded remain yours.

SUCH LIMITATION OF LIABILITY SHALL APPLY TO PREVENT RECOVERY OF DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, AND PUNITIVE DAMAGES WHETHER SUCH CLAIM IS BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, (EVEN IF Stahancyk, Kent & Hook OR ITS LICENSORS HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES). THIS LIMITATION SHALL ALSO APPLY, WITHOUT LIMITATION, TO THE COSTS OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES, LOST PROFITS, OR LOST DATA. SUCH LIMITATION SHALL FURTHER APPLY WITH RESPECT TO THE PERFORMANCE OR NON-PERFORMANCE OF THE SERVICES OR Divorce on Demand SITE OR ANY INFORMATION OR MERCHANDISE THAT APPEARS ON, OR IS LINKED OR RELATED IN ANY WAY TO, THE Stahancyk, Kent & Hook SERVICES. SUCH LIMITATION SHALL APPLY NOTWITHSTANDING ANY FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY AND TO THE FULLEST EXTENT PERMITTED BY LAW.

Without limiting the foregoing, under no circumstances shall Stahancyk, Kent & Hook or its licensors be held liable for any delay or failure in performance resulting directly or indirectly from acts of nature, forces, or causes beyond its reasonable control, including, without limitation, Internet failures, computer equipment failures, telecommunication equipment failures, other equipment failures, electrical power failures, strikes, labor disputes, riots, insurrections, civil disturbances, shortages of labor or materials, fires, floods, storms, explosions, acts of God, war, governmental actions, orders of domestic or foreign courts or tribunals, non-performance of third parties, or loss of or fluctuations in heat, light, or air conditioning.
These Terms of Service will be governed by and construed in accordance with the laws of the State of Oregon, without giving effect to its conflict of laws provisions or your actual state or country of residence. If for any reason a court of competent jurisdiction finds any provision or portion of the Terms of Service to be unenforceable, the remainder of the Terms of Service will continue in full force and effect. These Terms of Service constitute an agreement between the parties with respect to the subject matter hereof and supersedes and replaces all prior or contemporaneous understandings or agreements, written or oral, regarding such subject matter (including, but not limited to, any prior versions of the Terms of Service). Any waiver of any provision of the Terms of Service will be effective only if in writing and signed by an authorized representative of Stahancyk, Kent & Hook.
